Information We Collect
We may collect or record basic personal information (e.g., name, e-mail address, mailing address, phone number) which you voluntarily provide through forms on our Site, through the electronic mail you send to us, or through other means of communication between you and us.
We may also collect general non-personal information pertaining to users of our Sites, including IP addresses, source domain names, specific web pages, length of time spent, and pages accessed. This information is collected, among other things, to aggregate statistical information, facilitate system administration and improve the Site. These third-party websites are operated by companies that are outside of our control, and your activities at those third-party websites will be governed by the policies and practices of those third parties. Employee Personal Information
We also collect personal information from our employees and from job applicants (human resource data) in connection with the administration of our human resources programs and functions. These programs and functions include, but are not limited to: job applications and hiring programs, compensation and benefits program, performance appraisals, training, access to our facilities and computer networks, employee profiles, employee directories, human resource recordkeeping, and other employment-related purposes. It is our policy to keep all past and present employee information private from disclosure to third parties. There are certain business-related exceptions and they are:
- To comply with municipal, regional, provincial or federal agency requests;
- Inquiries from third parties with a signed authorization from the employee to release the information, except in situations where limited verbal verifications are acceptable (see below);
- Third parties with which we have contractual agreements to assist in the administration of company sponsored benefits.
Prospective employers, government agencies, financial institutions, and residential property managers routinely contact us requesting information on a former or current employee’s work history and salary. All such requests of this type shall be referred to and completed on a confidential basis by the human resources department or payroll department. For written verification of employment requests, information will be provided on the form only when it is accompanied by an employee’s signed authorization to release information. The form will be returned directly to the requesting party and filed as part of the human resources or payroll department’s confidential records.
Passive Collection
As is true of most websites, we gather certain information automatically. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, the files viewed on our Site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to analyze trends in the aggregate and administer the Site.
Tracking Technologies
MyMediabox and its partners use cookies or similar technologies to analyze trends, administer the Site, track users’ movements around the Site, and to gather demographic information about our user base as a whole. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our Sites.
How we use that information
We use the information we collect to provide you with services which you request, inform you when there are notifications or actions for you to perform as a part of using the Sites, and to improve our existing services and the content of our Sites. We also operate as a data processor for our business customers. Our business customers remain the information controllers with respect to any personal data submitted and stored in the Sites by users that were invited and approved by the business customer. The primary purpose in using your personal data is to provide a contextual relationship between you and the intellectual property of our business customers that you are downloading, uploading, and interacting with on the Sites. We, therefore, act in accordance with the instructions of such customers regarding the collection, processing, storage, deletion and transfer of customer information, as well as other matters such as the provision of access to and rectification of customer information.
When you contact us, we may keep a record of your communication to help solve any issues that you might be facing. Your information may be retained for a reasonable time for use in future contact with you, or for future improvements to our services. You have the option to opt-out or opt-in for further communications from us.
In certain situations, MyMediabox may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may also use or disclose your personal information when we believe, in good faith, that such use or disclosure is reasonably necessary to (i) comply with a subpoena, bankruptcy proceedings, or similar legal process as required by law, (ii) enforce or apply the terms of any of our user agreements, or (iii) protect our rights, property or safety, or the rights, property or safety of our users, or others. We reserve the right to transfer and disclose your information if we become involved in a business divestiture, change of control, sale, merger, or acquisition of all or a part of our business.
If you wish to subscribe to our newsletter(s), we will use your email address to send the newsletter to you. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, or accessing the email preferences in your account settings page.
We do not sell or provide our services to children. As such, our Sites are designed for adult user interaction. We do not intentionally collect personally identifiable information from children under the age of 13.
How we protect that information
EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework
MyMediabox complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland transferred to the United States pursuant to Privacy Shield. MyMediabox has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. Security
The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.
We use reasonable measures to safeguard personally identifiable information, which measures are appropriate to the type of information maintained, and follows applicable laws regarding the safeguarding of any such information under our control. Monitoring and Enforcement
We regularly review our compliance with our privacy policy. We also adhere to several self-regulatory frameworks in addition to complying with applicable law. If we receive formal written complaints, we will follow up with the person making the complaint. We work with the appropriate regulatory authorities to resolve any complaints that cannot be resolved directly.
How you can control your information, including accessing, updating and deleting what we store
Accessing and Updating Your Personal Information
Upon request, MyMediabox will provide you with information about whether we hold any of your personal information. If you have provided us with your personal information, you have the right to inspect the information stored by us for accuracy, or may request that the information be removed from our files. We will make a reasonable effort to comply with such requests within 10 to 15 business days except where it would require a disproportionate effort (for example developing a new system or changing an existing practice). We may require that you verify your identity before we act on a request to edit or remove your information. Please direct any questions about your information to the Privacy Contact identified below to review any personal information held about you.
If you successfully log in to your account on any business customer Sites you may visit the Profile page to view, export, edit, and correct your personal information for that Site, or you may request that your personal information be forgotten / deleted for all Sites, after which you will no longer be able to use the business customer Sites. If you desire to opt of the use of certain personal data for specific purposes, you may remove your personal data or contact the business customer of the Site that approved your account to express your choice.
How we share information collected
Information We Share
As a data processor, MyMediabox does NOT share your personal information with any third party business partners or service providers. We process and store your personal information on behalf of and may transmit your personal data to our business customer, the data controller, via the Site or some other secure data transfer mechanism, for the sole purpose of the business you conduct with our business customer.
Unless otherwise specified or prohibited, the only entity that we will share your personal information with is the business customer of the Site (the company that is the data controller who has entered into a legal agreement with MyMediabox to provide the Site as Software as a Service) where your personal information was submitted.
In the event that it becomes necessary in the future to share your personal information with any third party business partners or service providers you will be affirmatively notified and be provided the ability to opt-in or opt-out, consistent with legal requirements and the Privacy Shield Frameworks, as applicable, before such sharing happens.
MyMediabox is responsible for the processing of personal information it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. In particular, MyMediabox remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process personal data on its behalf do so in a manner inconsistent with the Principles, unless MyMediabox proves that it is not responsible for the event giving rise to the damage.
Social Media and Online Engagement
We occasionally use a variety of new technologies and social media options to communicate and interact with customers, potential customers, employees and potential employees. These sites and applications include popular social networking and media sites, open source software communities and more. To better engage the public in ongoing dialog, certain of our businesses use certain third-party platforms including, but not limited to, Facebook, Twitter and LinkedIn. Third-Party Websites and Applications (TPWA) are Web-based technologies that are not exclusively operated or controlled by us. When interacting with those websites, you may reveal certain personal information to us or to third parties. Other than when used by our employees for the purpose of responding to a specific message or request, we will not use, share, or retain your personal information.
